as some of you may know from previous posts i have been suffering due to the construction going on on miami beach waterfront

what should be paradise has been a nightmare

being me i don't suffer quietly so i went to the city

commissioner matti bower gave me not one but two appointments calling in the city attorney building department and code enforcement

yesterday ms. bower was elected mayor of miami beach

the laws for construction on miami beach are going to be changed

and violating those new laws will result in heavy fines which will be used to purchase oceanfront property and create parks

quality of life

they had a dewatering pump (a F# major chord in the middle of the bass clef) running 24/7 for over a year

anything 24/7 is going to drive people psycho

if i had known how to turn that pump off i would have done so as an act of 'civil disobedience' - i did manage to get local abc news out to do a story

it was not only loud it actually was shaking the neighboring buildings

i would wake up because my bed was vibrating

i lived with ear plugs and headphones on 24/7

it was also a diesel pump - on martin luther king day (when by law NO CONSTRUCTION is allowed - national holiday) and as i was coming from the beach there was a TANKER full of diesel delivering fuel to the project

i had constant asthma attacks

the crew is often loud and disrespectful - making crude remarks as construction workers tend to do

there are acoustical engineers that can lessen the noise but of course it would up the cost of construction

the developer and the construction company have both told me 'it is all economics'

well it should not be 'all economics' there are ethical and environmental issues involved

fortunately we have a new 'green committee' and our new governor is a big time environmentalist - he replaced jeb bush

the city and the state intend to subscribe to the kyoto agreement whether or not it is adopted nationally

miami beach is a naturally beautiful place and we are a wealthy city - there are no slums or ghettos or projects on miami beach

as i told the city at a commission meeting 'there is no shortage of developers lusting after our gorgeous waterfront - you can demand better conditions for the residents - why aren't you ? '

i ended up with an 'environmental sleep disorder'

i ended up in the hospital due to exhaustion from not sleeping (cost was $13,000)

i am moving away from the ocean to get some peace and quiet

miami beach is also going wifi for free and i hope that this encourages some tech industry

miami beach is known for having the most beautiful people of the major cities but is also known as having the least brain power of the major cities

miami/miami beach is kind of like the new york of south and central america but nationally except for construction and hedonism we don't really register on the radar

Better watch it. I heard that any kind of sound, whether it be quiet or loud, can cause hearing damage over an extended period of time. (If it's listened to over an extended period of time....)

yes as a musician that is a major issue

thus the ear plugs

also as a musician who writes at home (using headphones so not to disturb my neighbors) why is my right to make money superseded by the economic interests of the developers

intellectual property is not less valuable than real property

i really wish i had a law degree - i may go for one - i can do another three years

not to practice law but for the ***** slapping power

rather than gain personal benefit by suing i have decided to gain benefits for my fellow residents

and since environmentalism is 'in' the tide is with me

any politician that takes a stand against the environment is committing political suicide

and it is not like you can buy your way out of my horror of the last two years

the people paying $10 millions for the penthouse in the offending building will have to listen to the same thing as they are going to start new construction right next door and they are trying to get a zoning variance to demolish my current building which is an historic building and is supposedly 'protected'

anyway the new mayor is matti to me and what i ask for she is more than willing to help

as i told the city 'if you had left me in peace i would have left you in peace but since you didn't you are going to have to deal with me'

i just got the keys to my new place

it is so quiet it is as if someone turned off the audio

i went in sat in the corner and cried i am so grateful to get out of here

tomorrow my new bed is delivered

i wish you guys were here in time/space so you could move all my stuff

i think i will sleep for a couple of months i am so burnt

i feel like i have been granted a reprieve from some crime

i must have had some seriously bad karma to work off or maybe this experience was to bring me to the mindset of being an activist for noise control

peace and quiet

those words are so often connected so i am thinking that maybe quiet has a lot to do with peace

and of course peace is the best thing anyone/everyone could have

Congratulations, dude! I understand what you mean about construction-- i wouldn't be able to stand it for as long as you did.

I would definitely go for the law degree if I had the time. The knowledge you will learn will be invaluable!

it is teal not blue

and i get attention just by showing up

you are not the only person to have a problem with that but it doesn't bother me which only makes me all the more infuriating

well i got moved

it took twelve hours to deconstruct one environment and reconstruct another elsewhere including get my cable internet on

there are parrots hanging out on the wires outside my window

some of them sit real close and fly off together i think they are couples

i stay within the law

but the day i sell my internet business idea to google :) and it is my decision as to where we build our headquarters i am going back to the city and telling them

'you enact noise control laws on construction or i am building in nyc and you can continue being left our of the tech smart money loop'
