Neil Gaiman gives his opinion in regards to fair use and the J. K. Rowling copyright law suit. He indicates that he’s all in favour of fair use, with the lawsuit covering a very grey area of the law. He cannot imagine himself being involved in a similar situation.

Eh. Its a grey area, that's true. However, the direct and implied consent from the series creator protects that web site operator IMO.

However, referencing Harry Potter in a meaningful way intended to promote or earn money without consent given is a no no.

That said, Neil Gaiman cannot touch Harry Potter's level of popularity. The references to his work in film, TV and literature are, comparatively, minimal.
