I dont mean to generate traffic to my site, but awhile ago Danny showed me some of his commercials and then this week when I saw Stranger Than Fiction I was shocked when Sony's The Wait played during the previews.

That was pretty blatant there with the music...at least Danny's commercial made sense, I am not even sure what the hell Sony was trying to say. Maybe it would have made sense if the kid had a sony branded backpack, was listening to a walkman, while talking on a Sony-Ericsson celll-phone...hugh? Don't steal that idea Sony!!!

lmao, the product placement in that movie was atrocious
ford, sony, rolex, omega, smirnoff, all of the cars driven by characters were Ford owned.
the bahama opening shots looked like a Ford commercial

My wife still works for Marketing Magazine for another week so maybe I can see about an article on this. it's certainly not something you could persue legally. My question is though, what is that piece of music? and what else has it been used in?

There was a recent Apple commercial that ripped off someone's music video, frame by frame, same music in a similar fashion. Then it was considered an "homage". I'll see if I can find links.... IIRC it was last year's Superbowl.
Danny man, that shit sucks. And with Sony's deep pockets, I don't see how you could ever win.

I agree... but that's what Bond movies have been since the 90's. It's no excuse, but it's not the first time that they have done it.

It was the Apple commercial for the Intel switch, and it ripped off the video for The Postal Service's song Such Great Heights.
The thing about that was, the guy who did the Apple commercial also directed the Such Great Heights video.

Hey guys. I really appreciate everyone's thoughts on this. I am not sure if the makers of that sony spot saw my commercial or if it is just extremely similar. My "Mitchell and Ness" commercial never aired and I don't have the rights to use that music since it is a "director's cut" never to BE aired, just on my reel. So I'm not sure I have any legal rights or authority-- all I know is I made my commercial 3 years ago, I'm proud of it, it is still on my reel and I'm glad you all dig it.

Isn't copyright infringement fun? I'm actually taking Copyright in law school right now, and while I would love nothing more than to analyze all the different elements of protection and infringement with you fellows, I'm not sure I'm up to that task yet. And with finals less than a month away, I think I need to study more.

Damn, so many crap commercials make it to air... this is one of the better commercials i have seen in a while its really a shame it never aired. Must look great as part of your reel though :)

So that narrows it down... it was ripped off by someone who saw your reel...
You know, if it were me I wouldn't be so much angry about someone stealing an idea that was mine, as I would be angry about what it means. It means that the person who ripped me off actually got a JOB, but is so LAZY and TALENTLESS that they can't think up something of their own so they go casting about for obscure things they can copy. I wonder if they had someone else do their papers in college, too.
I mean, Why the **** do they have a job and not you?? Even if you don't have a legal leg to stand on, this person should be exposed as a fraud.

Danny's commerical had a storyline, and you connected with the character in the commercial all in 30 seconds! Sony's was just dark, dreary, and scary looking. All of the commercials leading up to the release of PS3 have been crazy weird. I don't know what Sony is thinking.
Oh, wait. They're thinking, "$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$".
