Many won't care about this thread but I hope some will. My situation is that I am a junior in high school and, while watching an 80s bus safety movie involving a bus safety rap, took out my iPhone to listen to music as I don't even ride the bus. I saw at least 6 people within ten feet of me doing the same thing, and at least 50 people turned around and talking to people, clearly not paying attention. I was quickly asked to remove my headphones by a nearby teacher, I complied and unplugged them and was holding them when retard fury struck said teacher the second he saw I still had the headphones at all and had not immediately purged them with salt and fire, he told me that he would take them so I would not be tempted to put them in my ears. now, I understand that a teacher in a school is authority but my property is not theirs when I enter their domain, I was happy to find an alternative such as putting them in my pocket or setting them as well as my iPhone on the seat next to me so he knows they are not in use but I do not give my personal property to anyone I wouldn't trust my life with. needless to say it escalated after I told him that I would not relinquish my personal property to him no matter what but if he has another solution I'm all ears. the assembly ends and I am whisked off to the office after being pushed around by one of the teachers friends. Long story short I am suspended, I ask for an appeal, I have the appeal meeting and it buys me a week before I am actually suspended. I would be simply pissed if they had not gone to another teacher who was not there and asked his side of the story and he lied his ass off about how I was arguing and being physically aggressive and he suggested I be suspended longer, my parents also agree the verdict was bullshit and it did little.
Well tomorrow I am going into school to get my books and I want to get back at him for being a total dick and lying. I was thinking of making posters and sticking them up but I haven't thought of any good ones yet. If anyone could give me suggestions on what I should make or even make a design it would be awesome. if you want to use names here they are.

Maybe you ought to keep your cool and not get yourself into more trouble. There's no good reason to get yourself into warranted trouble after being dragged into unwarranted trouble.

Dude, if the rules of your school are that you can't wear headphones, then they're totally in the right. I brought my walkman to high school when I was younger (Yeah, a walkman), and they took it from me. Stuff like that, you can pick up later with a parent.
But, you decided to start arguing with them and they had every right to take them from you. They gave you a chance to put them away, yet you decided to keep them out in the open. In a teacher's eyes, they figure that as soon as they're out of sight, you're going to put them right back on.
Now, if you think about this for a moment, they're looking forward to a confrontation from you and your family, so they're going to be prepared. I say follow the path of least resistance, admit you were wrong, apologize, and they will give you back your iPhone.

I went to a private school. And if you looked at the teacher wrong, passed notes, whispered in class, chewed gum, didn't tuck your shirt in ---> principal's office. And depending on the level of the offense, you were paddled -- straight up no messing around hardcore corporal punishment.
Heck, you couldn't even go to the restroom without a hall pass.
Some of the rules may be dumb, but you have to follow them. You need to be sweetness and light to these teachers. They have the ability to ruin your life if you get on their bad side. That's just the way it is.
These guys are kings and queens of their respective classrooms. Humor them, its not like you will be there long anyway.

that's some hard rules. my teacher told our class how to even skip class. we're allowed to chew gum, eat, drink, listen to music (independant work) and show up late. no punishments.
although this is only a select few teachers rules, some are a little more strict

I have been in so may similar situations in school.
My advice even if you are in the right.
Let it go,more often then not things just end up worse when you don't.
Just not worth it.
(this is esp true in jr high)
btw Jr high sucks for everyone it's just a matter of what degree of suckage you experience.;)

They DO have the right to take your property. Not giving it to them is BREAKING a rule. Breaking rules has consequences. Not to mention, making a poster is only going to get you suspended for longer or expelled.
The teacher may have made a bad call, but that doesn't make him the irrational one in this situation.

Honestly, i think you should leave it alone until the appeal comes up. You have 2 weeks to prepare for the hearing so make sure your story is 100% accurate. Maybe it would be cool if people who where sitting next to you or around you that would write a statement saying what happened and that the teacher didn't give you any other alternative after you said asked for one. Just be prepared for anything that could possible be said. Remember the best thing to do is be 1 step ahead of the game. Anything that could be asked try to have a an answer while being completely CALM and looking straight into the persons eyes. By being calm the ENTIRE time really does help your case. It shows you have nothing to hide. And by looking the person in their eyes also will help your situation out also.
As far as getting back at the teacher. When I was younger around 16-20 I would of said some horrible things to do. But seriously now that I'm 26, by you winning the case and NOT being suspended, TRUST me, that will make him more mad than anything you could mentally or physically do to him. those are just my two cents, I hope you picked something up from what I've said. Believe in what I wrote I was a bad teenager and those option I told you will work in your advantage.

A few scratches are negligible. If you're so concerned, carry around the thing in a protective case so you can at least give it to them in it. Are you even allowed to have phones in the school? Not what everyone else does, I mean what the actual rules of the school are, what you have to agree with to be part of the school. Even if they are, I doubt it's ok to pull it out in class time.
Honestly, you sound incredibly spoiled. Why the hell would you start listening to that while in class hours? It's like saying you don't intend to use Geography so you can do whatever you want in that time.
The mere fact that you took it out and didn't put it away is like taunting the teacher. Put it away and show some damn respect.

Could the teachers be in the wrong in some way? Yeah, but you put yourself in the situation. When I was in high school I knew some teachers were just ridiculous, getting a little bit physical, making people stand out in the sun with their hands in the air or some other random thing. Toughen up a little. Sure it was a bit more than necessary, but usually the people involved would be repeat trouble-makers. You know, the kind that are disrespectful, like you, give back chat, like you, and have a problem with authority, like you, wanting to "get back" at them.

(my best friends are teachers, but not assholes) If the Damn school allows you to bring Phones/iPods etc, then they should expect to see students using them. If they ask/tell ya to remove them/not use them, and ya do. then fuck them to high hell. I'ts the school systems problem for allowing them on campus to begin with.

we posted simo, so you may have missed that I added an addendum. I Never anywhere in my post said he should do the poster stuff, I did that as a kid and failed. I just him to get together with folks and witnesses and contest it at the upcoming meeting. That is all.

Take it from me, there is nothing to gain from being a "bastard" to authority. There's been a number of times within school I would get in trouble for doing something stupid and standing up for myself because it was the "right thing to stand up for." Like "f" the man. I've always gotten ahead when I bit my tongue and just moved on.
I think you should do the same in this case. If your things are really damaged, go to the top authority with a solid case, but don't handle it in a way that can get you in trouble.

If I went to the appeal with you and you got denied (and you were my son) in front of the administration I would say:
"Well son. It looks like you just got a week long vacation! Wana go to six flags?"
The school has no right to take your private property. That's theft. My brother sometimes takes my old iPod to school (he listens to it on the bus). If a teacher ever takes it from him I'm going to go over and ask for it back. If they try giving me BS that they have to talk to a parent I'm going to tell them its my property and that I'm calling the Maryland state police and am pressing theft charges if they don't hand it over. That would be a fun scenario. :)
High school blows man. I don't know how I put up with it. Don't do anything to "get back" at the teacher. You've done nothing wrong as far as I'm concerned assuming you're telling the truth. Keep it that way.

yeah. I don't want him to "get back" as in revenge. That will only hurt his case, I just want him to fight, through proper channels, his case. Like i said, I think he'll lose. But he will win just from learning from the experience.
and later in life, when he fights for his rights, he will have a jumping off point from this experience. Ask me, we got a lawyer in budding here. :)

This always bugged me:
My school administrators always stated they had the right to search us if they suspected we had drugs on us.
I'm sorry, but a dinky principle has no legal right to search an individual or their private property. Hell, even a cop doesn't without probable cause or a warrant.
I can tell you this much. If my future son or daughter is ever searched by a teacher or principle I'm pressing charges.

A lot of teachers suck. The first day of school one year I was a Junior I believe. I wouldn't do any work in this one teachers class, I had him as a freshman so he knew how I was. He sent me to see a vice principal after a talk with the VP I didn't have to do any work in the class if I didn't want to and sleep if I wanted, teacher never bothered me about the work. In fact we got along fine. :D

Don't get me wrong though. You shouldn't have had your phone out. I'm not saying you should have gone without punishment. I just don't think a teacher has the right to take your personal property. It's bad for both parties. What if it gets stolen etc.
Make the kid go to detention or write a paper about why it's disrespectful to take his phone out. That or even make him loose the privilege of being able to bring the phone to school. But taking it away? No, I don't think they should be able to do that.

"I don't give people my personal property" doesn't exempt you from a rule that states phones are not permitted and if you are found with them they will be taken away for a certain amount of time. Assuming there is such a rule.

What if it's broken or stolen in the mean time though? That puts the school liable. It's just not a good idea. There are other things they could do.

You deal with that when it occurs. Yes it's a reality, a reality you could avoid by not getting in the situation in the first place. So follow the rules.

So how is it not easier for the school to find an alternate form of punishment rather then taking the property and assuming the risk of it being stolen which may be followed by legal threats?
Isn't it easier to simply say "You just earned detention. If I see the phone again you not only lost your privilege of bringing it to school but you'll also be suspended?"
No threat of theft or legal action.

The one that always got me was the tardy slip. If you were a second late past 8:00am, you had to get a tardy slip from the office. You could only have three per semester, if you went past that you got detention. And if you were chronically late, you could get suspended and expelled (I never got to that point -- I got detention one time).

Isn't it easier to simply say "You just earned detention. If I see the phone again you not only lost your privilege of bringing it to school but you'll also be suspended?"
No threat of theft or legal action.
Throw the phone in a drawer, and that's it. Don't overthink it. And not taking it away means the students don't feel it. The message is to not have the phone. Take away the phone AND give detention sounds more like it.

So how is it not easier for the school to find an alternate form of punishment rather then taking the property and assuming the risk of it being stolen which may be followed by legal threats?
Isn't it easier to simply say "You just earned detention. If I see the phone again you not only lost your privilege of bringing it to school but you'll also be suspended?"
No threat of theft or legal action.

Many won't care about this thread but I hope some will. My situation is that I am a junior in high school and, while watching an 80s bus safety movie involving a bus safety rap, took out my iPhone to listen to music as I don't even ride the bus. I saw at least 6 people within ten feet of me doing the same thing, and at least 50 people turned around and talking to people, clearly not paying attention. I was quickly asked to remove my headphones by a nearby teacher, I complied and unplugged them and was holding them when retard fury struck said teacher the second he saw I still had the headphones at all and had not immediately purged them with salt and fire, he told me that he would take them so I would not be tempted to put them in my ears. now, I understand that a teacher in a school is authority but my property is not theirs when I enter their domain, I was happy to find an alternative such as putting them in my pocket or setting them as well as my iPhone on the seat next to me so he knows they are not in use but I do not give my personal property to anyone I wouldn't trust my life with. needless to say it escalated after I told him that I would not relinquish my personal property to him no matter what but if he has another solution I'm all ears. the assembly ends and I am whisked off to the office after being pushed around by one of the teachers friends. Long story short I am suspended, I ask for an appeal, I have the appeal meeting and it buys me a week before I am actually suspended. I would be simply pissed if they had not gone to another teacher who was not there and asked his side of the story and he lied his ass off about how I was arguing and being physically aggressive and he suggested I be suspended longer, my parents also agree the verdict was bullshit and it did little.
Well tomorrow I am going into school to get my books and I want to get back at him for being a total dick and lying. I was thinking of making posters and sticking them up but I haven't thought of any good ones yet. If anyone could give me suggestions on what I should make or even make a design it would be awesome. if you want to use names here they are.

Sorry Rabid...I have to agree with Sam and Skyz. There's a difference between "fighting the Man" and being spoiled. You break the rules, you pay. If you're a dick about breaking the rules, you pay more. Had he sincerely put it away, the phone wouldn't have been taken.

d. Safety videos are boring as hell, but required. Just like "sensitivity training" in real jobs. Ever seen the result of a bus accient? How about the results of a man getting sucked into a spinning metal lathe? Yeah, safety is important. He might not ride the bus to school, but how about they ban him from field trips because he didn't watch the video?
