I just got one taking a walk around my neighborhood with my cousin and friend and found ourselves getting questioned by a cop. The cops sons car got broke into and the cop got one of his cop friends to question my cousin and friend about it a while back as they were walking around the neighborhood. That cop told my cousin and friend to "take the nature walk somewhere else". My aunt and uncle complained about it and the cop was reprimanded and the cops boss called and apologized.
Well tonight, we walked by the cops house and the cop just got home. As we pass he gets his flashlight out and shines it on us and says "Do you live around here?". I asked why and he said "What!?" in a loud voice and started walking up to us fast. I asked again why again and he said "cars are getting broken into around the neighborhood". I told him my address and said "Are you gona have to see my ID as well?". He shined the light on all of us and said "No...I just want to get a good look of your face" and walked away.
Is there anything we can do about this? Is this harassment? What are my rights when getting questioned by a cop? Do I have to tell him info about where I live or show my ID? What if he never identified himself as a cop (he didn't but it was obvious he was)?

No there is not much you can do, cops are basically immune from the law, and thats why they suck. It is really hard to get a cop in trouble, in fact cops have killed innocent people only to get paid vacations. Now not all cops suck, but a lot of them do. You should TRY to do something about it (look into some local laws and state laws and whatever) and see if there is anything you can do, but even if you found out he was breaking the rules, chances are slim you will get anything done about, especially because you are young.
I know it sucks...

This seems to be less about cops and more about a douche of a neighbor.
Don't hate on cops. Tell your neighbor to shove it.

Yes but he IS a cop and he is using his power as a cop to harass people. There are a lot of cops like this, you think everyone is so ignorant that they will do whatever a cop says, no questions asked. Now don't get me wrong, I know a lot of good cops, but there are also a lot of bad ones.

It's catchy, but not from my country, that's Jamaican, yech! Now, "Who Let The Dogs Out?" instills country pride for me! :p

I agree with you, Kow. Don't get angry to the 4-O, get angry with the people that make them a necessity.

I've had a cop get up in my face and scream at me and my mom called the police station later and he said he was just trying to get my name. I was 16 or so at the time. Apparently there was supposed to be a fight at the skate park which the school administration got word of so they notified the police. We got down there and cops pulled in right behind us, and he randomly started asking our names and writing them down. Before I gave him my name, I politely asked "What's going on, why do you need my name?" and he got closer to me and said "Give me your name." And I said, "I'll give you my name, I'd just like to know what's going on here." That's when he got in my face and screamed at me.
I seem to remember something about self-incrimination, but I guess it doesn't matter when you're 16.

Yeah it makes me so mad when police go after 16 year olds and ignore all the rules because they assume you won't know them. It's happened to me many times. And the whole "It's ok, we are on your side. It will be better if you just admit to what happened." This happened once when I called the police because there was a propane leak. It was pretty major and they needed the fire men to come and fix stuff and the fire men (or people) where thanking me and my friends for helping out. The cops then came and asked us to admit to tampering with the propane tank. They told us we would be in trouble if we didn't admit to it.
Well we stuck to out story, and they wanted to see our camera (we make films). We showed them the tape and they said "Well it must be on another one". Well we were tired by than so we said "If you want to look through all 50 of our one hour tapes for this, have fun."
We should have said you have no right to our property unless you have a warrant, which you won't get."

I hate cops because they almost always have some kind of arrogance to themselves. As if they are so much better then us and we are suppose to be afraid of them. But most of the time the cops you run into on the street or who pull you over especially in cities are rookies or havent been around for more then 2 or 3 years and still have that chip on their shoulders. It seems the longer they stick around they develop a better sense of when to apply force and when to just be an average guy with a gun :D

Yeah i find it mainly the younger cops for sure, too bad all the older cops around here we transfered or retired.

With my story before though, I have had a lot of good experiences with cops, and I wish they'd realize that "good cops" are much more effective than "bad cops" except for when they are dealing with real criminals, not just kids. My friends and I were filming for a school project out in a field and some lady called the cops on us. The cops came, asked us our story, were cool and calm with us, and we were honest with them, and they just said "Well, be careful where you're filming and try to stay away from her house and that area." Perfectly fine. Even though it pissed me off that the lady called the cops on us after I smiled at her and waved when we walked by, but whatever. I also had a cop let me off of a warning/ticket because my tags needed changed on my car, but it was under my mom's name(and birthday) so I had no idea. He was polite and said "I'm not going to follow you home or watch you leave, just make sure you drive straight home and have your mom take care of that before you drive it again." Using tact and being polite isn't a bad thing, and I wish people would realize that. Just because someone is young doesn't mean they are immature and/or stupid. Don't act like an idiot or get out of control until the person you're dealing with requires that kind of "force".

By all means cops are NOT in any case immune from the law. Next time he askes you should say "Back off" and keep walking. That is, if he's not in uniform or not on duty. He's got no right and yeah, he should definitely be reported. It could be considered harassment because he is abusing his power as a cop. Sorry for your situation.

Well, you are right as long as, in your area, the majority of cops are "good" cops. Because if they are all like this who are you going to report it to? Also cops rarely get punished for things like this. So no, by the word of the law they are not immune from it, but since they are the onces enforcing it, it's tough sometimes to get anything done about it.

Im pretty sure he was in uniform however Im not too sure (its hard to see with a bright flashlight shining in your eyes). He also never identified himself as a cop so we really didn't have to answer any of his questions.
When it comes to being questioned by a cop:
Does a cop need probable cause to ask for ID? Also, can I get arrested for not answering a cops questions such as in this case?

You were in a public place - he has no rights to ask for ID unless there is a criminal investigation. He could consider the breakin of his sons car a criminal investigation though.
Cops don't need to be in uniform either - they just need to identify themselves as policemen, and if out of uniform, produce THEIR ID first if you ask to see it before providing yours. Even if they are in uniform, ask to see ID. There are a number of instances (particularly if a car is eing pulled over) where people wearing what looks like police uniforms falsely ID themselves as cops, then have their way with teenagers driving Altimas.

I don't hate 5-0.
But I hate hearing the "you have been selected for random searching" at the airport.
If you want to search me based on what's on my passport, just do it, don't give me some shitty fake excuse that it magically is my turn. lol.

I have flown 14 times since 9/11. I have been selected for random searches 12 of those 14 times. I have had my bags inspected and the little TSA note, I'm pretty sure, all 14 times.
I think it's because I'm a democrat! ;)

By no means are cops immune. You have your civil rights and you can exercise them with cops if you so choose.
I remember seeing a video on youtube one time that was explaining what to do when you get pulled over. I'll have to look for it. It was showing how to avoid getting caught with drugs (which I'm not encouraging) but it had some good information. One of the things it mentioned is how cops ask you when you get pulled over, "You know why I stopped you?" They ask you that because they want to get you to admit to some kind of wrong doing. You are not legally required to answer that question. So it suggested to not answer at all or ask the cop why you got pulled over. I remember many of the things it was telling you to avoid was getting caught up in giving up information you don't need to.
The main example on the video was how cops ask to search your car. You can say no unless they have "probable cause" which means they saw a beer can or suspicious pipe or something in your car through your windows or something. Basically they need a real reason to search your car, otherwise they have no authority whatsover to look in it and you cannot get in trouble by denying them in searching your car. It might not make the cop so friendly though, but if you are really adamit about your civil rights, than you can exercise them with cops.
The video also explained how cops get you to willingly give up your rights simply by clever questioning or wording.

Heres is another story on why I hate cops:
Over the summer I went to the movies with some friends. On the way back we got pulled over by a cop. It turns out, we got pulled over because his tag light was out (he just got done doing some work on his car and forgot to hook it back up). Well the cop asked for all of our IDs and asked to search ALL of us and the car. They were smelling my energy drink and when they searched me the said "Oh...what is THIS!?" only to find out that it was a stick of gum.
I wouldn't have given permission for them to search me but it was my friend getting pulled over and I was hoping if we remained friendly they would let him off with a warning. They ended up letting him go with a VERBAL warning. That just goes to show you that their intentions were to search us when they pulled us over and not the tag light.

Look dude, there are a lot of crooked cops. Most of them are on the show "Cops". My uncle is a cop in Saskatoon, a City in Saskatchewan with a consistantly high murder rate and racial issues with the natives. He, though, is a great person and likely a good cop.
I don't disagree man. Some cops are about 2 steps left of criminal.

I agree, some cops suck but others are ok. I've been pulled over for speeding a few times and I think majority of those time I've been let go. But there was this time I was pulled over for my exhaust being too loud - I knew that was bullshit because it was the stock exhaust at the time...what a fricken idiot state trooper. The ****ed up thing about the whole thing is my brother is a cop - a damn SWAT member at that.

When it comes to being questioned by a cop:
Does a cop need probable cause to ask for ID? Also, can I get arrested for not answering a cops questions such as in this case?
First....I'd advise you to take "legal" advice from an Internet forum with a grain of salt. You'll be safer by calling your local police station or calling a lawyer in your town about what is or is not legal in your area. Laws can be different everywhere.
My interpretation of your first question would lead me to a "Yes" answer. However, it's just as easy to label "suspicious activity" or "loitering" as probable cause.
As to the second question, I'll provide you with a link to a reputable site... read the section "Responding to Questions Before an Arrest": FindLaw.com (http://criminal.findlaw.com/articles/1404.html)
...hope that helps.
Personally, these people risk their lives every day for less money than the average retail store manager... cut them some slack and be polite... they could turn your life upside down in a heartbeat. (although they would also endure repercussions from devious actions)
