Hey guys, Today at work we got a memo about people supposedly posting 'status' updates on facebook that were about supervisors and managers at the company. The memo stated that any person caught doing this would basically be warned and if felt needed there job would be terminated. Now from what I hear the post wasn't that bad, it was basically that the managers couldn't organize a p*** up in a brewery, and I think there was another post aimed at a supervisor in particular.

Now I know that the bosses at our company are not tech savvy in anyway, but I think that what they are trying to do is to use scare tactics for people so they don't post stuff like that on there but isn't that against freedom of speech? I'm just glad that I don't use facebook and they have no clue what twitter is :).

Not much legal ground to stand on EXCEPT if it was done during work hours or using a company provided laptop.

I guess you could make the free speech argument. But you could also walk up to your boss outside of office hours and call him/her an asshole. Good luck with that free speech argument though. ;)

Free speech is an odd concept, because it gives people the feeling that they can say whatever they like. Unfortunately for those people they forget that while speech is free it is often not without consequence.

Libel and slander for example. Add in violations of trade practice, HIPAA, and SEC rules and it is pretty apparent that free speech is actually limited.
