Is he ever going to give up? He acts as if it's some kind of crusade.

Would it be possible for Revision3 to ban him from the member account so that he would have to wait until Monday to download it?

EDIT: Not Striker (sorry). PSX00.

Hmm, im not paying attention to this much cause i might as well be watching news on the government screwing us or iraq cause this is all so stupid, but isnt striker PSX00 ?

I just suggested the company add a TOS agreement to member accounts with a clause that states "no member shall re-distribute content before it's public release". This may make it easier to ban people that do this.

They just need to put a huge red disclaimer at the end of the video.

"The public license granted to subscribers does include the right to redistribute the preceding video program before July 16, 2007"

Despite that fact that rights reserved need not be explicit. An explicit statement that the early redistribution of "diggnation" during the prerelease period is not permitted.

This would basically nullify the whole "We have a right to do this under CC" bullshit argument.



In any event, even if the website in question never had a positive cash flow. The fact that donations to the site covered a subscription for at least a year is a financial gain. It's not necessary to make a profit to claim a finical gain. Indeed, following Mr. S's own numbers, he operated a website and enjoyed a year's subscription to Revision3 all for less than $2. By distributing "diggnation" from his website, he didn't lose as much money as he would have without distributing it. By his own numbers, he experienced a a financial gain from the activity. That is specifically prohibited by all but the most permissive CC license structures. Even collecting monies to cover the expense of redistribution is not permitted.

I would have a lot more sympathy for his crusade if he did it all out of his own pocket. It would still be wrong, I would just have more sympathy.

Well, I'm not interested in stopping anyone....except stopping them from littering the forum with irrelevancy.

Mr. S. and his legion would do more to prove their point by moving-on and quietly setting up shop someplace else. It was only through shamelessly promoting their website on this very forum that Revison3 was alerted.

All the piss and vinegar is about getting attention and personal offense, none of which really matters.

I love how it seems to be some sort of holy war now....the new site even says "Don't let them silence us." If you are fighting the people that put out the content, and the people that are in the content, then what is the point? I think he's just doing it now to make a point. While that is okay sometimes, I don't think this is a big enough deal to warrant this type of reaction.

He isnt doing it to make a point he is doing it for attention. He wont even accept responsibility for his actions, he claims his GF makes him do it cause its taking up too much time and has nothing coming back in?

His logic is "Fans wanted to watch it early, I provided. Not every fan can get a PayPal, some are too young or live in a unsupported country."

And they cant afford to wait a few days either eh?

This is all gonna be moot either way soon, so just let it blow by off the radar. Infact the more its talked about the more its to his benefit at this point, so i would suggest stop benefiting him.

BTW PSX00 isn't Striker.

A while back PSX00 had his psx00.com site (don't worry it's not registered anymore) and Striker had his site. PSX00 shut down his website because he said he was a senior in High School and he didn't want to pay for bandwith and needed to study.

people in the content, eh? I clearly remember Kevin and Alex saying on Cranky Geeks that they had very little to nothing to do with the cease and desist, and that it was the "legal team."

In any case, yea they are probably doing it to make the point that no matter what Rev3 tries doing, short of doing away with early release, there will always be people breaking their system, welcome to the "tech" industry.

And about the "reaction" I think a lot of it is the same with the reaction people had with the HDDVD code being censored on Digg. Threads discussing this topic were just closed for no reason, Rev3 is/was stone walling all the ideas for a solution, and some fans, myself included, no longer feel like this is Kevin and friends fun company/project, but that they are turning into what they said they would a "TV company on the internet." Yea, the reaction for the initial thing is probably overkill, but the situation hasn't changed since then on either side.
