iPod synchronization problems?

I've found that some episodes of Penn Point are not synchronizing with my iPod. It seems to be episodes that were encoded with Lavf52.78.3 instead of mp4creator 1.5.0.1. For example, the 4/27/2011 episode (F@#% You! Part 1) and 4/4/2011 (Agnostics Suck!).

Anybody else having this problem?

I second this concern. I've downloaded 6 episodes that fail to load - including the 5 latest the episodes. This is for an iPod Nano 3rd gen.

Is the new encoding necessary for some overriding business/technical reason or can you go back to the old encoder?
